Of course, we comply with the legal provisions of the Swiss Federal Act on Data Protection (FADP), the Ordinance to the Federal Act on Data Protection (OFADP), the Telecommunications Act (TCA) and other potentially applicable data protection provisions of Swiss or EU law, in particular the General Data Protection Regulation (GDPR). So that you know which personal data we collect from you and for what purposes we use it, please take note of the information below.

A. Data processing in connection with our website

0. SSL encryption

To protect the data you transmit as effectively as possible, the website operators use SSL encryption. You can recognise such encrypted connections by the prefix “https://” in the page link in your browser’s address bar. Unencrypted pages are marked by “https://”.
All data that you transmit to this website – for example when making enquiries or logging in – cannot be read by third parties thanks to SSL encryption.

1. The following technical data is recorded automatically, as is generally the case with every connection to a web server, without any action on your part, and stored until it is automatically deleted:

the IP address of the requesting computer,

the name of the owner of the IP address range (usually your internet access provider),

the date and time of access,

the website from which access was made (referrer URL), if applicable including the search term used,

the name and URL of the file accessed,

the status code (e.g. error message),

the operating system of your computer,

the browser you use (type, version and language),

the transmission protocol used (e.g. HTTP/1.1) and

if applicable, your username from a registration/authentication

This data is collected and processed for the purpose of enabling the use of our website (establishing a connection), ensuring long-term system security and stability, and enabling the optimisation of our online offering, as well as for internal statistical purposes. This constitutes our legitimate interest in data processing within the meaning of Art. 6(1)(f) GDPR. The IP address is also analysed together with the other data in the event of attacks on the network infrastructure or other unauthorised or abusive website use, for clarification and defence, and may be used in the context of criminal proceedings to identify the users concerned and to take civil and criminal action against them. This constitutes our legitimate interest in data processing within the meaning of Art. 6(1)(f) GDPR.

2. Use of our contact form

You have the option of using a contact form to get in touch with us in order to order a voucher. For example, we use cookies to temporarily store your selected services and entries when filling out a form on the website, so you don’t have to repeat the entry when you visit another subpage. Cookies may also be used to identify you as a registered user after you have registered on the website, without you having to log in again when you visit another subpage.

Most internet browsers accept cookies automatically. However, you can configure your browser so that no cookies are stored on your computer, or so that a notice always appears when you receive a new cookie. Storage and sharing of data with third parties

7. Booking platforms

If you make bookings via a third-party platform (such as Booking.com), we receive various personal information from the respective platform operator. This is generally the data listed in section 3 of this privacy policy. In addition, enquiries about your booking may be forwarded to us. We will process this data in particular to record your booking as requested and to provide the booked services. The legal basis for data processing for this purpose is the performance of a contract pursuant to Art. 6(1)(b) GDPR. Finally, we may be informed by the platform operators about disputes in connection with a booking. In doing so, we may also receive data relating to the booking process, which may include a copy of the booking confirmation as proof of the actual conclusion of the booking. We process this data to safeguard and enforce our claims. This constitutes our legitimate interest within the meaning of Art. 6(1)(f) GDPR.
Please also note the data protection information of the respective provider.

8. Central storage and linking of data
We store the data specified in sections 2–3 and 5–7 in a central electronic data processing system. The data relating to you is systematically recorded and linked for the processing of your bookings and the handling of contractual services. We base the processing of this data within the software on our legitimate interest within the meaning of Art. 6(1)(f) GDPR in customer-friendly and efficient customer data management. 9. Retention period
We store personal data only for as long as is necessary to use the tracking services mentioned above as well as the other processing within the scope of our legitimate interest. We retain contract data for longer, as this is required by statutory retention obligations. Retention obligations that require us to retain data arise from regulations on reporting law, accounting and tax law. According to these regulations, business communications, concluded contracts and booking receipts must be retained for up to 10 years. If we no longer need this data to provide services to you, the data will be blocked. This means that the data may then only be used for accounting and tax purposes. 10. Disclosure of data to third parties
We only disclose your personal data if you have expressly consented, if there is a legal obligation to do so, or if this is necessary to enforce our rights, in particular to enforce claims arising from the contractual relationship. In addition, we disclose your data to third parties insofar as this is necessary in the context of using the website and processing the contract (also outside the website), in particular for processing your bookings.
A service provider to whom the personal data collected via the website is disclosed, or who may have access to it, is our web host netfuchs gmbh, Untere Bönigstrasse 10a, 3800 Interlaken. The website is hosted on servers in Germany. The data is disclosed for the purpose of providing and maintaining the functionality of our website. This constitutes our legitimate interest within the meaning of Art. 6(1)(f) GDPR.
Finally, when paying by credit card on the website, we forward your credit card information to your credit card issuer and to the credit card acquirer. If you choose to pay by credit card, you will be asked to enter all required information. The legal basis for the disclosure of the data is the performance of a contract pursuant to Art. 6(1)(b) GDPR. With regard to the processing of your credit card information by these third parties, we ask you to also read the general terms and conditions as well as the privacy policy of your credit card issuer.
11. Transfer of personal data abroad
We are entitled to transfer your personal data to third companies (commissioned service providers) abroad for the purposes of the data processing described in this privacy policy. These companies are obliged to protect data to the same extent as we are. If the level of data protection in a country does not correspond to that of Switzerland or Europe, we ensure contractually that the protection of your personal data corresponds at all times to that in Switzerland or the EU.

D. Further information

12. Right of access, rectification, deletion and restriction of processing; right to data portability
You have the right to request information about the personal data we store about you. In addition, you have the right to have incorrect data corrected and the right to have your personal data deleted, provided that no statutory retention obligation or legal basis permitting us to process the data prevents this.

You also have the right to request from us the data you have provided to us (right to data portability). Upon request, we will also transfer the data to a third party of your choice. You have the right to receive the data in a commonly used file format.

You can contact us for the above purposes via the email address abegglen(at)dulac-iseltwald.c. To process your requests, we may, at our discretion, require proof of identity.

13. Data security

We use appropriate technical and organisational security measures to protect your personal data stored with us against manipulation, partial or complete loss, and unauthorised access by third parties. Our security measures are continuously improved in line with technological developments.

You should always treat your access data confidentially and close the browser window when you have finished communicating with us, especially if you share the computer with others.

We also take internal data protection very seriously. Our employees and the service companies we commission have been obliged by us to maintain confidentiality and to comply with data protection regulations.

14. Note on data transfers to the USA
For the sake of completeness, we would like to point out to users resident or domiciled in Switzerland that in the USA there are surveillance measures by US authorities that generally allow the storage of all personal data of all persons whose data has been transferred from Switzerland to the USA. This happens without differentiation, limitation or exception based on the objective pursued and without an objective criterion that would make it possible to limit access by US authorities to the data and its subsequent use to very specific, strictly limited purposes that could justify the interference associated with both access to this data and its use. In addition, we would like to point out that in the USA there are no legal remedies available to the persons concerned from Switzerland that would allow them to obtain access to the data relating to them and to have it corrected or deleted, or that there is no effective judicial protection against general access rights of US authorities. We explicitly inform those affected of this legal and factual situation so that they can make an appropriately informed decision about consenting to the use of their data.

We would like to point out to users resident in an EU member state that, from the perspective of the European Union, the USA does not have an adequate level of data protection – among other things due to the topics mentioned in this section. Insofar as we have explained in this privacy policy that recipients of data (such as Google) are based in the USA, we will ensure either through contractual arrangements with these companies or by ensuring that these companies are certified under the EU or Swiss-US Privacy Shield that your data is protected with an adequate level of protection by our partners.

15. Right to lodge a complaint with a data protection supervisory authority
You have the right to lodge a complaint with a data protection supervisory authority at any time.

16.
